HEXAORGIN — TERMS OF SERVICE & PAYMENT POLICY

1. Scope & Engagement Model
HexaOrgin operates as a managed digital solutions and drop-servicing
intermediary. HexaOrgin facilitates end-to-end project management,
quality assurance, milestone governance, and financial escrow between
Clients and specialized digital professionals. By submitting a project
request, accepting a quotation, or accessing the HexaOrgin portal, the
Client enters into a binding agreement governed by these Terms.
2. Quotation, Scope & Multi-Currency Settlement
Binding Quotation: Every project initiates with a formal Quotation specifying the agreed scope of work, technical specifications, deliverable milestones, estimated timeline, settlement currency, and total investment fee.
Multi-Currency Support: Projects may be quoted and settled in supported global currencies, including USD, INR, EUR, GBP, AED, CAD, AUD and SGD. The currency established in the approved quotation remains fixed for the duration of the project.
Scope Precision: Any services, assets, integrations, or functionalities not explicitly detailed in the approved Quotation are considered outside the project scope and subject to change order billing.
3. Advance Payment & Project Activation
Advance Deposit Requirement: All projects require an initial advance payment, standard 50% of the total quotation fee, or as otherwise specified in the Quotation.
Conditional Activation: Work will not commence, and project status will remain pending (AWAITING_ADVANCE), until the required advance payment has been successfully processed and verified by HexaOrgin Administration.
Timeline Calculation: Estimated project delivery schedules begin on the date the advance deposit is officially verified, not the date of project submission.
4. Specialist Allocation & Platform Intermediation
Specialist Assignment: HexaOrgin assigns verified specialists based on domain expertise, including Full Stack Development, UI/UX Architecture, Mobile Engineering, AI/ML, DevOps and Cybersecurity.
Reassignment Protocol: HexaOrgin reserves the right to reassign or replace specialists at any time to guarantee project velocity and quality standards without altering the Client's agreed pricing.
Platform Intermediation & Privacy Isolation: All communication, milestone reviews, deliverable exchanges and payments must occur strictly through HexaOrgin. Direct off-platform contact or private settlement between Clients and assigned specialists is strictly prohibited.
5. Revisions & Scope Modification
Included Revisions: The approved Quotation establishes the permitted number of revision rounds, standard two rounds of design or structural feedback within the agreed scope.
Revision Turnaround: Revision requests must be submitted through the portal within five business days of deliverable presentation.
Out-of-Scope Change Orders: Requests involving new feature sets, fundamental architectural changes or additions beyond the approved scope will be issued a separate Change Order Quotation with additional costs and revised timelines.
6. Deliverable Handover & Final Balance Settlement
Milestone Review: Deliverables, including source code repositories, staging previews, production builds or design files, are presented to the Client for verification prior to final handover.
Final Payment Trigger: Upon deliverable review and milestone approval (CLIENT_APPROVAL), the remaining balance becomes due immediately (PENDING_FINAL).
Asset Release: Final production source code, domain deployment keys, full administrative credentials and unwatermarked assets will be released strictly upon receipt and administrative confirmation of the final payment.
Intellectual Property Transfer: Full copyright and ownership of the bespoke deliverables transfer to the Client exclusively upon 100% full financial settlement of the project fee.
7. 100% Refund Policy & Eligibility Guarantee
HexaOrgin guarantees a 100% refund of amounts paid under the following specific circumstances:
- Pre-Execution Cancellation by HexaOrgin: The project is declined or cancelled by HexaOrgin before substantial design, engineering or development work has commenced.
- Inability to Fulfill: HexaOrgin is unable to assign a qualified specialist or undertake the project scope due entirely to internal constraints attributable to HexaOrgin.
- Unremedied Non-Delivery: Final deliverables fundamentally fail to meet the written technical specifications of the approved quotation, and HexaOrgin fails to rectify the issue within a mutually agreed 14-day remedy period.
8. Refund Exclusions & Non-Refundable Conditions
A refund, full or partial, will not apply in the following circumstances:
- Work in progress, substantial completion, milestones delivered or project deliverables presented in alignment with the quotation.
- Client change of mind after the advance deposit has been confirmed and specialist execution has begun.
- Client non-responsiveness or failure to provide necessary assets, credentials, copy, design assets or approvals for more than 14 consecutive calendar days.
- Non-recoverable third-party expenses, including domain purchases, server provisioning, software licenses, API subscriptions and paid plugins.
- Off-platform circumvention, including attempts to contact, solicit or settle payments with HexaOrgin specialists directly outside the platform.
9. Refund Request & Adjudication Procedure
Submission: Refund requests must be officially lodged via the HexaOrgin Client Portal (/client/projects/[id]) stating specific technical discrepancies against the approved Quotation.
Administrative Review: HexaOrgin Administration adjudicates all refund requests within 3–5 business days, conducting a code or milestone audit of submitted deliverables.
Disbursement: Approved refunds will be credited via the original payment gateway or bank wire within 5–10 business days, subject to the processing schedule of the respective financial institution.
10. Client Responsibilities & Cooperation
The Client agrees to:
- Provide complete, accurate and unambiguous project specifications, assets and credentials.
- Designate a single point of contact with decision-making authority for milestone approvals.
- Review submitted deliverable previews promptly to avoid project stagnation.
- Honor all scheduled milestone payments in accordance with the project quotation.
11. Limitation of Liability
HexaOrgin is not liable for indirect, incidental or consequential
damages, loss of business revenue or downtime resulting from third-party
services, API changes, hosting provider outages or post-delivery
modifications executed by non-HexaOrgin personnel. Total liability is
capped at the total amount actually paid by the Client for the specific project.
12. Acknowledgement & Acceptance
By registering an account on HexaOrgin, submitting a project request or
making an advance payment towards an approved quotation, the Client
confirms that they have read, understood and agreed to be bound by these
Terms & Conditions, Payment Terms and Refund Policy.
